Vilma's defamation suit against Goodell dismissed

New Orleans Saints linebacker Jonathan Vilma's defamation lawsuit against NFL Commissioner Roger Goodell in connection with the bounty case was dismissed by a federal judge on Thursday.
U.S. District Judge Ginger Berrigan in New Orleans ruled in favor of Goodell's motion to dismiss Vilma's complaint, which was filed in May and set out 11 claims. Vilma had argued that Goodell made false statements, tarnishing the player's reputation, in connection with the league's investigation of what it determined was a system that offered cash bonuses to Saints players for big hits from 2009-11.
"Even though this matter has been pending only since May ... it feels as protracted and painful as the Saints season itself, and calls for closure," Berrigan wrote in her decision. "The Court nonetheless believes that had this matter been handled in a less heavy handed way, with greater fairness toward the players and the pressures they face, this litigation and the related cases would not have been necessary."
Goodell initially suspended Vilma for all of the 2012 season ? although he wound up being able to play while appealing ? and three other players received shorter bans: Saints defensive end Will Smith and two former Saints, Cleveland linebacker Scott Fujita and free agent defensive lineman Anthony Hargrove. But Paul Tagliabue, Goodell's predecessor as commissioner, heard a final round of player appeals and threw out the suspensions last month.
NFL spokesman Greg Aiello said neither he nor Goodell would have any comment Thursday about Berrigan's ruling.
Peter Ginsberg, a lawyer for Vilma, wrote in an email: "We are obviously disappointed, strongly believe that the CBA does not give anyone ? including a commissioner ? a license to misrepresent and to manufacture facts, especially at the expense of another person's reputation ? and are considering our options."
Berrigan wrote that "Vilma maintains that Goodell is responsible for the allegedly offending statements in his individual capacity." The judge rejected that as "unpersuasive," saying: "The Court finds that all of the allegedly offensive statements were made by Goodell as Commissioner of the NFL in conjunction with the investigation resulting in the now well-known discipline against Vilma and others associated with the Saints."
Vilma's lawsuit pointed to six statements made by Goodell ? including in NFL news releases, memos to the league's 32 teams, and an interview with the NFL Network.
"While the Court is extremely disturbed by the fundamental lack of due process in Goodell's denying the players the identities of and the right to confront their accusers, that was substantially rectified later in the process," Berrigan wrote. "So while the process was initially procedurally flawed, the statements were ultimately found to have enough support to defeat the defamation claims."

Sandy aid package moving toward House votes
WASHINGTON (AP) ? Northeastern lawmakers hoping to push a $50.7 billion Superstorm Sandy aid package through the House face roadblocks by fiscal conservatives seeking offsetting spending cuts to pay for recovery efforts as well as cuts for projects they say are unrelated to the Oct. 29 storm.
Their amendments set up a faceoff Tuesday as the House moved toward votes on the emergency spending package, with Northeast lawmakers in both parties eager to provide recovery aid for one of the worst storms ever to strike the region.
The base $17 billion bill by the House Appropriations Committee is aimed at immediate Sandy recovery needs, including $5.4 billion for New York and New Jersey transit systems and $5.4 billion for the Federal Emergency Management Agency's disaster relief aid fund.
Northeast lawmakers will have a chance to add to that bill with an amendment by Rep. Rodney Frelinghuysen, R-N.J., for an additional $33.7 billion, including $10.9 billion for public transportation projects.
The Club for Growth, a conservative group, is urging lawmakers to oppose both Sandy aid measures. Sandy aid supporters, nonetheless, voiced confidence Monday they would prevail. The Senate passed a $60.4 billion Sandy aid package in December with bipartisan support.
Lawmakers emerging from a private meeting of House Democrats Tuesday morning said they were urged to support the bill despite imperfections.
House Majority Whip Steny Hoyer, D-Md., said after a private meeting of House Democrats Tuesday morning that he believed the full Sandy measure would pass. He said he was expecting about 50 Republican votes for the $33 billion portion of the measure, and he said he believed the votes would be there for the $17 billion portion and to defeat a GOP across-the-board spending cut amendment as well.
"I think we'll be all right," he said.
Rep. Nita Lowey, D-N.Y., said Congress had waited far too long to act, 79 days after the storm struck.
"It is imperative that we pass this package today," said Lowey.
The House will consider 13 amendments, including one requiring spending offsets and four seeking to strike money for some projects either not directly related to Sandy or not seen as emergency spending.
As with past natural disasters, the $50.7 billion Sandy aid package does not provide for offsetting spending cuts, meaning the aid comes at the cost of higher deficits. The lone exception is an offset provision in the Frelinghuysen amendment requiring that the $3.4 billion for Army Corps of Engineers projects to protect against future storms be paid for by spending cuts elsewhere in the 2013 budget.
Sandy aid supporters are most concerned about the amendment by conservative Reps. Mick Mulvaney, R-S.C., Tom McClintock, R-Calif., Jeff Duncan, R-S.C., and Cynthia Lummis, R-Wyo., to offset the $17 billion base bill with spending cuts of 1.6 percent for all discretionary appropriations for 2013.
Northeast lawmakers said passage of the Mulvaney amendment could complicate prospects for quick action on the broader Sandy aid package in the Senate, which has passed a $60.4 billion aid package with bipartisan support that does not have offsetting spending cuts.
Mulvaney said he wasn't trying to torpedo the aid package with his amendment.
"This is not a poison pill," he said. "It's not designed for delay. ... I just want to try and find a way to pay for" Sandy aid.
Other amendments set for floor debate would cut $15 million for Regional Ocean Partnership Grants, $13 million for the National Weather Service ground readiness project, $1 million for the Legal Services Corporation and $9.8 million for rebuilding seawalls and buildings on uninhabited islands in the Steward McKinney National Wildlife Refuge in Connecticut.
House Speaker John Boehner, R-Ohio, planned votes on both the $17 billion base bill and the Frelinghuysen proposal for $33.7 billion more. He's responding both to conservatives who are opposed to more deficit spending, and to pointed criticism from Govs. Andrew Cuomo, D-N.Y., and Chris Christie, R-N.J., who are fuming because the House hasn't acted sooner.
Boehner decided on New Year's Day to delay a scheduled vote after House Republicans rebelled over a bill allowing taxes to rise on families making more than $450,000 a year because it included only meager spending cuts. Christie called the speaker's action "disgusting."
The Senate's $60.4 billion bill on Sandy relief expired with the previous Congress on Jan. 3. But about $9.7 billion was money for replenishing the government's flood insurance fund to help pay Sandy victims, and Congress approved that separately earlier this month. Whatever emerges from the House this week is scheduled for debate in the Senate next week after President Barack Obama's second inauguration.
FEMA has spent about $3.1 billion in disaster relief money for shelters, restoring power and other immediate needs after the storm pounded the Atlantic Coast with hurricane-force winds. New York, New Jersey and Connecticut were the hardest hit.

Panetta: U.S. will take 'necessary' steps in Algerian hostage situation
ALGIERS, Algeria (AP) ? As Algerian army helicopters clattered overhead deep in the Sahara desert, Islamist militants hunkered down for the night in a natural gas complex they had assaulted Wednesday morning, killing two people and taking dozens of foreigners hostage in what could be the first spillover from France's intervention in Mali.
The Algerian army has surrounded the complex and about 1,000 miles (1,600 kilometers) from the coast, there is no obvious way for the kidnappers to escape in their four wheel drive vehicles with their hostages.
A militant group claimed responsibility for the rare attack on one of oil-rich Algeria's energy facilities, saying it came in revenge for the North African nation's support for France's military operation against al-Qaida-linked rebels in neighboring Mali. The militants said they were holding 41 foreigners from the energy complex, including seven Americans.
The group ? called Katibat Moulathamine or the Masked Brigade ? phoned a Mauritanian news outlet to say one of its affiliates had carried out the operation at the Ain Amenas gas field, located 800 miles (1,300 kilometers) south of Algiers, the Algerian capital, and that France must cease its intervention in Mali to ensure the safety of the hostages.
BP, together with the Norwegian company Statoil and the Algerian state oil company Sonatrach, operates the gas field. A Japanese company, JGC Corp, provides services for the facility as well.
In Rome, U.S. Defense Secretary Leon Panetta declared that the U.S. "will take all necessary and proper steps" to deal with the attack in Algeria. He would not detail what such steps might be but condemned the action as "terrorist attack" and likened it to al-Qaida activities in Pakistan, Afghanistan and in the United States on Sept. 11, 2001.
Algeria's top security official, Interior Minister Daho Ould Kabila, said that "security forces have surrounded the area and cornered the terrorists, who are in one wing of the complex's living quarters."
He said one Briton and one Algerian were killed in the attack, while a Norwegian and two other Britons were among the six wounded.
"We reject all negotiations with the group, which is holding some 20 hostages from several nationalities," Kabila said on national television, raising the specter of a possible armed assault to try to free the hostages.
The head of a catering company working on the base told the French Journal de Dimanche that helicopters were flying over the complex and the army waited outside. There were even reports of clashes between the two sides and a member of the militant group told the Mauritanian news outlet they had already repelled one assault by Algerian soldiers late Wednesday night.
It was not immediately possible to rectify the discrepancies in the number of reported hostages. Their identities were also unclear, but Ireland announced that they included a 36-year-old married Irish man and Japan, Britain and the U.S. said their citizens were involved as well. A Norwegian woman said her husband called her saying that he had been taken hostage.
Hundreds of Algerians work at the plant and were also taken hostage in the Islamist attack, but the Algerian state news agency reported they were gradually released unharmed Wednesday in small groups.
The Algerian minister said the militants appeared to be hoping to negotiate their departure from the area, something he rejected. He also dismissed theories that the militants came from across the border in Libya, which is just 60 miles (100 kilometers) away, or from Mali, more than 600 miles (1,000 kilometers) away.
Kabila said the roughly 20 well armed gunmen were from Algeria itself, operating under orders from Moktar Belmoktar, al-Qaida's strongman in the Sahara.
In Washington, U.S. State Department spokeswoman Victoria Nuland confirmed that "U.S. citizens were among the hostages."
The caller to the Nouakchott Information Agency, which often carries announcements from extremist groups, said the kidnapping was carried out by "Those Who Signed in Blood," a group created to attack the countries participating in the offensive against Islamist groups in Mali.
The Masked Brigade was formed by Belmoktar, a one-eyed Algerian who recently declared he was leaving the terror network's Algerian branch, Al-Qaida in the Islamic Maghreb, to create his own group. He said at the time he would still maintain ties with the central organization based in Afghanistan and Pakistan.
The name of his group could be a reference to the nomadic Tuareg inhabitants of the Sahara, known for masking their faces with blue veils.
A close associate of Belmoktar blamed the West for France's recent air and ground intervention against Islamist fighters in Mali.
"It's the United Nations that gave the green light to this intervention and all Western countries are now going to pay a price. We are now globalizing our conflict," Oumar Ould Hamaha told The Associated Press by telephone Wednesday night from an undisclosed location.
French President Francois Hollande launched the surprise operation in Mali, a former French colony in West Africa, on Friday, hoping to stop the al-Qaida-linked and other Islamist extremists whom he believes pose a danger to the world.
Further kidnappings could well be on the horizon, warned Sajjan Gohel, the international security director for the Asia-Pacific Foundation.
"The chances are that this may not be a one-off event, that there could be other attempts in Africa ? especially north and western Africa ? to directly target foreign interests," he said. "It's unclear as to what fate these individuals may meet, whether these terrorists are going to want a ransom or whether they'll utilize this for propaganda purposes."
Wednesday's attack in Algeria began with an ambush on a bus carrying employees from the massive gas plant to the nearby airport but the attackers were driven off, according to the Algerian government, which said three vehicles of heavily armed men were involved.
"After their failed attempt, the terrorist group headed to the complex's living quarters and took a number of workers with foreign nationalities hostage," the government said in a statement.
Attacks on oil-rich Algeria's hydrocarbon facilities are very rare, despite decades of fighting an Islamist insurgency, mostly in northern Algeria.
In the last several years, however, al-Qaida's influence in the poorly patrolled desert of southern Algeria and northern Mali and Niger has grown and the group operates smuggling and kidnapping networks throughout the area. Militant groups that seized control of a vast section of northern Mali last year already hold seven French hostages as well as four Algerian diplomats.
Prime Minister David Cameron's office said "several British nationals" were involved, while Japanese news agencies, citing unnamed government officials, said there are three Japanese hostages.
Late Wednesday, Statoil said five employees ?four Norwegians and a Canadian ? were safe at an Algerian military camp and two of them had suffered minor injuries. It said 12 employees were unaccounted for.
The Norwegian newspaper Bergens Tidende said a 55-year-old Norwegian working on the site called his wife to say he had been abducted.
Algeria had long warned against any military intervention against the rebels in northern Mali, fearing the violence could spill over its own long and porous border. Though its position softened slightly after Hollande visited Algiers in December, Algerian authorities remain skeptical about the operation and worried about its consequences on the region.
Algeria, Africa's biggest country, has been an ally of the U.S. and France in fighting terrorism for years. But its relationship with France has been fraught with lingering resentment over colonialism and the bloody war for independence that left Algeria a free country 50 years ago.
Algeria's strong security forces have struggled for years against Islamist extremists, and have in recent years managed to nearly snuff out violence by al-Qaida in the Islamic Maghreb around its home base in northern Algeria. In the meantime, AQIM moved its focus southward.
AQIM has made tens of millions of dollars off kidnapping in the region, abducting Algerian businessmen or politicians, and sometimes foreigners, for ransom.

KFC eager to spread its wings in Africa

YUM! Restaurants International continues to expand the footprint of its KFC brand on the African continent, with plans to add stores in Tanzania, Uganda and Zimbabwe this year, the company said on Monday.
"Africa is undoubtedly one of the fastest-growing regions globally and KFC is fully committed to harnessing this opportunity and building a sustainable business model on the continent," said Bruce Layzell, KFC general manager of new African markets.
Global brands are progressively looking to emerging markets to offset sluggish growth in traditional economies? and Africa presents a compelling investment case for retailers. The Economist Intelligence Unit predicts that by 2030? Africa?s top 18 cities could have a combined spending power of $1.3-trillion.
One of the main drivers of Africa?s growth spurt is the increasing pace of urbanisation and consumerisation.
The number of KFC restaurants in new African markets grew to 63 at the end of last year, in countries such as Angola, Nigeria, Malawi and Ghana. The figure excludes South Africa, Egypt, Morocco and Mauritius, which, if included, brings the total number of KFC restaurants on the continent to almost 900 outlets.
Local company Famous Brands, whose portfolio includes Wimpy, Debonairs Pizza and Steers, said heightened interest from prospective franchisees continued in the rest of Africa.
The company has outlets in more than 15 African countries including Nigeria, Ghana and Zambia.
There is a caveat: Africa is not an easy place to do business. Key risks include the lack of real estate? currency volatility? high taxes? corruption and red tape.
According to Spur Corporation CEO Pierre van Tonder, African expansion is "made out to sound like it?s a pot of gold".
"But whatever you think is going to take 12 months there actually takes you 24 months. You need to be a facilitator in developing Africa? you need to be flexible? and you cannot take your corporate governance baggage out of South Africa and expect to develop in Africa?" Mr van Tonder said last year.
Famous Brands CEO Kevin Hedderwick said: "We?ve been in Africa for 12 years, we are not like those guys who just started there yesterday. We?ve paid our school fees ? it?s a tough place to trade."
In the 2013 financial year? Spur Corporation plans to open eight new restaurants in Africa in countries such as Zambia? Kenya and Tanzania? as well as a second restaurant in Nigeria? two in Mauritius and one in the Seychelles.
Despite typical challenges such as power shortages, and a lack of quality building materials and potable water, KFC?s commitment to investing in Africa has not been diminished ? in fact, longer-term growth plans include establishing a KFC in the Democratic Republic of the Congo, Ethiopia and Senegal.
Mr Layzell warned that taking a blanket approach to conducting business in Africa did not work.
"Our KFC restaurants in each market differ ? our aim is to make our brand relevant in a local context. We won?t cut and paste a South African KFC into Nigeria or Zambia," he said.

Foot soldiers of the immune system
Jan. 13, 2013 ? Researchers at McGill University and the Research Center for Molecular Medicine (CeMM) of the Austrian Academy of Sciences have discovered the molecular blueprint behind the IFIT protein. This key protein enables the human immune system to detect viruses and prevent infection by acting as foot soldiers guarding the body against infection. They recognize foreign viral ribonucleic acid (RNA) produced by the virus and act as defender molecules by potentially latching onto the genome of the virus and preventing it from making copies of itself, blocking infection. The findings are a promising step towards developing new drugs for combatting a wide range of immune system disorders.
The discovery was made by teams led by Bhushan Nagar, a professor in the Department of Biochemistry at McGill's Faculty of Medicine, and Dr. Giulio Superti-Furga at the CeMM. Building on the 2011 CeMM discovery by Dr. Andreas Pichlmair that IFIT proteins unexpectedly interact directly with the viral RNA to inhibit its replication, the group's latest discovery reveals the molecular mechanism behind how IFIT proteins capture only the viral RNA and distinguishes it from normal molecules belonging to the host. Their research will be published on January 13 in the journal Nature.
"Infection by pathogens such as viruses and bacteria are caught by a layer of the immune system that consists of guard-like proteins constantly on the lookout for foreign molecules derived from the pathogen," explains Prof. Nagar. "Once the pathogen is detected, a rapid response by the host cell is elicited, which includes the production of an array of defender molecules that work together to block and remove the infection. The IFIT proteins are key members of these defender molecules."
When a virus enters a cell, it can generate foreign molecules such as RNA with three phosphate groups (triphosphate) exposed at one end, in order to replicate itself. Triphosphorylated RNA is what distinguishes viral RNA from the RNA found in the human host. During this time, the receptors of the innate immune system are usually able to detect the foreign molecules from the virus and turn on signaling cascades in the cell that leads to the switching on of an antiviral program, both within the infected and nearby uninfected cells. Hundreds of different proteins are produced as part of this anti-viral program, which work in concert to resist the viral infection.
In the Nagar lab, McGill graduate student Yazan Abbas used an arsenal of biophysical techniques, most notably X-ray crystallography, to capture the IFIT protein directly in the act of recognizing the foreign RNA. The work shed light on the interaction between IFITs and RNAs. The researchers determined that IFIT proteins have evolved a specific binding pocket, chemically compatible and big enough to fit only the triphoshorylated end of the viral RNA. Human RNA is not able to tightly interact with this pocket, thereby circumventing autoimmune reactions.
"Once the IFIT protein clamps down on the viral RNA, the RNA is then presumably prevented from being used by the virus for its own replication," says Superti-Furga, "Since many viruses, such as influenza and rabies, rely on triphosphate RNA for their lifecycle, these results have widespread implications in understanding how our cells interact with viruses and combat them."
This work could help advance the development of new drugs for combating a wide array of immune system disorders. "Our findings will be useful for the development of novel drugs directed at IFIT proteins, particularly in cases where it is necessary to dampen the immune response, such as inflammation or cancer therapy," says Nagar.

BEIJING (AP) ? Beijing schools kept children indoors and hospitals saw a spike in respiratory cases Monday following a weekend of off-the charts pollution in China's smoggy capital, the worst since the government began being more open about air-quality data.
City authorities, who began releasing figures about some of the worst kinds of pollutants early last year, ordered many factories to scale back emissions and were spraying water at building sites to try to tamp down dust and dirt worsening the noxious haze hanging over the city.
Demand spiked for face masks and air purifiers, and hospitals saw surges of up to 30 percent in residents seeking help for breathing problems, state-run media outlets reported. Schools in several districts were ordered to cancel outdoor activities such as flag-raisings and sports classes, and in an unusual public announcement, Beijing authorities advised all residents to "take measures to protect their health."
"It's really terrible. I'm extremely upset, but there's really nothing much I can do," said a Beijing resident out for a morning stroll. Like many Chinese, the man would give only his surname, Kang.
Another man, a 60-year-old retiree surnamed Chen, said his elderly relatives had moved to stay with family members outside the city to avoid the pollution.
"I'm in pretty good shape, but the older folks have a lot of problems with their hearts, breathing, and high blood pressure," Chen said.
Levels of PM2.5 particle pollution over the weekend reached the highest levels since the Beijing government began publicly releasing figures following a public outcry. In separate monitoring by the U.S. Embassy, level were at 886 micrograms per cubic meter in a reading that was labeled "beyond index."
By Monday, levels had declined to about 350 micrograms on the Beijing government scale ? down from a high above 700 but still way above the level of 25 considered safe by the World Health Organization.
PM2.5 are tiny particulate matter less than 2.5 micrometers in size, or about 1/30th the average width of a human hair. They can penetrate deep into the lungs, and measuring them is considered a more accurate reflection of air quality than other methods.
The Beijing Shijitan Hospital received 20 percent more patients than usual at its respiratory health department, Dr. Huang Aiben said. Most patients were coughing and sought treatment for chronic bronchitis, asthma and other respiratory illnesses, Huang said.
"Because these dust particles are relatively fine, they can be directly absorbed by the lung's tiny air sacs. The airway's ability to block the fine dust is relatively weak and so bacteria and viruses carried by the dust can directly enter the airway," Huang said.
Huang said exposure to such high levels of pollution over the short term can cause bacterial and viral infections, and prolonged exposure could result in tumors.
Beijing's air started to worsen on Thursday, and Beijing's monitoring center said the pollution was expected to linger until Tuesday.
Weather conditions are a factor, as a lack of wind means pollutants can easily accumulate and fail to dissipate, said Pan Xiao Chuan, a professor at Peking University's public health department.
"Recent pollution doesn't mean there is an increase in the discharge of pollutants," he said.
The government started publishing PM2.5 readings last year after public demands for more detailed air quality data, prompted in part by a Twitter feed from the U.S. Embassy that reported readings from the building's roof. A growing Chinese middle class has become increasingly vocal about the quality of the environment. Hourly air quality updates are now available online for more than 70 cities.
Air pollution is a major problem in China due to the country's rapid pace of industrialization, reliance on coal power, explosive growth in car ownership and disregard for environmental laws. It typically gets worse in the winter because of weather conditions and an increase in coal burning for heating needs.
Several other cities, including Tianjin on the coast east of Beijing and southern China's Wuhan city, also reported severe pollution over the last several days.

Sometimes, these things are hard to write. And sometimes writing them saves my life. This is one of those times I'm glad I have my blog here, and it's still so hard to write...
I took so many photos of him in the woods that someone made him his own Tumblr feed.
Amanda says he taught me how to love. She's probably right.
I cried. Amanda came and held me, and I cried some more. Holly called and I told her what had happened, and she cried too. It was so sudden and unexpected and I wasn't there with him when he went. And I'd lost my friend.
So. 30th of April 2007 I stopped and rescued a dog by the side of the road.

On the way home from the recording, driving through the rain, just as I pulled off the freeway to head home, I saw a large, pale dog on the side of the sliproad. I went in a couple of seconds from a first glance thought of "Oh, he's just wandering around and knows exactly what he's doing," to, on a second glance, "He's absolutely terrified and if he isn't actually lost he's really scared of all the cars and in danger of bolting onto the freeway," .
I pulled over, crossed the road and hurried across to where he was. He backed away, skittish and nervous, then came over to me, shaking. No collar or information, just a choke chain. And big. And very wet and very muddy. With cars going past, I decided the wisest thing to do was to put him into my car while I figured out what to do. The car was the Mini. I opened the door and he clambered in. The dog took up most of the Mini that I wasn't in and a fair amount of the Mini that I was in. Big dog, small car.
I phoned my assistant Lorraine, and asked her to let the local Humane Society (really nice people with a no kill policy) know we'd be coming in soon with a dog, then I drove home, narrowly avoiding death on the way (it's amazing how much you can't see when a huge dog fills the car and your field of vision). I ran around the garden with Dog until he'd tired me out. (I really hope he'd just got lost, and his family are looking for him; it would be hard to imagine someone abandoning a dog that cool.) Then I put him into the back of a car much bigger than the Mini and took him to the Humane Society, where they fawned all over him. ("I think he's a husky-wolf cross," said the Humane lady who took him, and she could be right.)
I think he's probably a survivor too.
And that was what he looked like when he climbed into the Mini.
I seem to have acquired a dog.It took a long time before he was actually white around the neck and chest. The grey of the metal chain had stained his fur grey.
I got a call today to say that the owner of the dog I found on Monday had called the Humane Society and collected him. I was happy Dog was back with his family, but found myself rather sadder than I would have expected -- I realised I'd half hoped that maybe no-one would claim him.
The call went on to say that the dog's owner, a local farmer, who kept him chained up in the yard, and couldn't walk well so couldn't walk him, thought the dog was a nuisance, always getting out and heading onto the freeway and sooner or later he'd cause an accident, and, when the Humane Society lady mentioned that the person who found him rather liked him, he told her that if I came over and picked him up I could have him.
So I did.
He'd been named Buck, in the farmyard, on the chain, but he didn't respond to it, and hadn't actually been called Buck by anyone, as far as I could tell. I called him Cabal, after King Arthur's white dog who could see the wind, and he seemed to like having a name he could respond to.
I'd never had a dog. I don't think he'd ever had a person. And we bonded. Over the next six years, we both changed and we both grew.
My house in the midwest is on about 17 acres of woodland. I rediscovered all of those acres, and local meadows as well. I had a friend at a time when I needed one badly: I was really lonely at the time. ?I'd separated from my children's mother, Mary, four years earlier, and she'd moved out, and the house was ?feeling very empty. I didn't really have anyone in my life, anyone who felt like mine.
I got unquestioning love from Cabal. Not in a subservient sort of way. When we went walking, he seemed fairly certain that he was in charge -- after all, he was faster, could smell things, and had a much better idea of how things worked in the woods.
He wasn't afraid of anything, except thunderstorms. And elevators.
I took so many photos of him in the woods that someone made him his own Tumblr feed.
He was less happy in the house. Sometimes his back legs would splay out from under him. He was wary of shiny surfaces, as if he'd had troubles over the years walking on ice in his farmyard.
We were a sort of an Odd Couple, both of us fascinated and delighted by the other one. Both of us protective. He'd stand between me and strangers; he'd move just out of my eyeline, and plant himself there; he was determined to keep me safe from cats, even though I had several cats, and had to divide the house into Cat and Dog territory (and I am not certain he ever realised that that was mostly for his safety, and not theirs).
People said we looked like each other. Some people even tried to prove this.
Amanda says he taught me how to love. She's probably right.
He had trouble with his back legs -- he'd run too fast, too far, too hard, and break the leg and keep going, or rip the tendon. There were operations, one on each, a year apart.
He always slept in my bedroom at night. And then he had increasing trouble getting up and downstairs, and I moved my bedroom downstairs, so he didn't have to worry about stairs. We put a ramp in outside the house so he could get in and out without worrying about stairs.
He was having more trouble walking outside: his front legs went where he wanted them to go, his back legs wandered and lurched. He was three when I got him. Now he was nine, and had a degenerative condition (degenerative canine myelopathy -- like MS for dogs). But he was always cheerful, friendly, and still capable of out-running a human in the woods if something interesting went past.
It made him sad and lonely when I travelled, so I got Lola to keep him company. It worked. Now, when I'd return, he'd be much more cheerful. Lola adored him, and put up with me because Cabal seemed convinced I was pack leader.
He was nine years old. An old, big dog. But still mine, with a determined, unquestioning love and loyalty I'd never known.
When I rented the place in Cambridge I'd planned to bring him out immediately, then I actually saw the house, saw the shiny slippery wooden floors and all the stairs and realised that wouldn't work. The dogs were going to come out here to be with me in about 8 weeks, when it would be warm enough for me to move my workspace out into the conservatory, and in the meantime I was going home whenever I could to spend time with him and Lola (and, over Christmas, my daughters). I was with him there a week ago. I go back in two weeks for a couple of weeks, and was already planning stuff to do with the dogs while I was there.
I got the phone call last night from Hans, who looks after the grounds and the house, from the vet's. Cabal had had a normal, fun day, and then suddenly got really ill. He was vomiting and having trouble breathing. I'd missed the last plane and was going to fly home this morning to be with him while he was ill. Another phone call: he and Mary my housekeeper were with Cabal, and they were both in tears. They put me onto the vet, who was going to try to get ?Cabal to the animal hospital. He couldn't breathe. The vet thought there was a blood-clot in his lung. Another call: he wasn't going to make it to the hospital. His heart had stopped. The vet had just brought him back to life, but he was barely able to breathe and she was worried about him going into seizures and dying in pain...
And I wasn't there. If I'd been there, he would have been okay with whatever was?happening. If I'd been there it would have been safe for him to go. I talked to him on the phone, intending to say something calming so he could hear my voice, and instead just cried and told him I was sorry that I wasn't there.
I spoke to the vet one last time, and told her to let him go,

Benefits of Enrolling in Community College After High School
If you plan to go to community college, you could be making a great choice. Whether you want to eventually go to a university or simply want your associate?s degree, you may like what you find when you go to a smaller school. Learn the benefits of attending this kind of institution.
The main advantage of enrolling in community college is the cost savings. In most cases, each credit hour is a lot less expensive than the typical university. This means you might not have to take out loans since many people simply work a part-time or full-time job to pay as they go. Even if you do need loans or scholarships to get through school, they will be in much smaller amounts than most universities require. You can usually at least get all your basic education requirements out of the way before transferring to a university that offers your desired major. This is why many people go for two years, and then transfer when they are done with basic courses.
In fact, it is not unusual for a community college to offer more than associate?s degrees these days. Some also have bachelor?s degrees, meaning you might not have to transfer, provided your school has the major you are interested in. Target to match some rivals' online prices year-round
(Reuters) - Target Corp said on Tuesday it will match on a year-round basis the prices found on the websites of key rivals Amazon.com Inc, Best Buy Co Inc, Wal-Mart Stores Inc and Toys R Us, its latest tactic to hold onto shoppers focused on price.
The move extends an online price-matching program that Target introduced over the holiday season and which was supposed to last only from November 1 to December 16. It also comes after Target last week reported flat sales growth in December at stores open at least a year.
"I think this is largely symbolic, it's akin to removing the Kindle from their stores," said Wells Fargo analyst Matt Nemer, referring to Target's decision to stop selling Amazon's tablet devices last year.
In November, Chief Executive Gregg Steinhafel said Target was not seeing a lot of price-match activity in its stores.
"It's not likely to have a huge impact on financials or customer behavior," said Nemer, who noted that customers are not likely to go to Target's guest services desk for a refund for just a small difference in price.
Also, much of what Target sells, such as apparel and accessories, is exclusive to the store, so there would be no comparable prices from competitors.
But Target will now also match prices year-round from its own website in its stores.
Nemer called that "a really important step," saying it removes confusion for customers who sometimes see different prices for products such as televisions in stores and online.
While shopping online has grown rapidly in recent years, it still represents a small fraction of overall shopping in the United States. Target's policy of matching online prices differs from policies at several chains, which match only printed advertised prices for items sold at stores.
Target said that throughout the year it will match the price when a customer buys an eligible item at one of its stores and finds the same item at a lower price in the following week's Target circular or in a local competitor's printed ad. It will also match the price if the customer finds the same item at a lower price within a week on Target's website or the websites of Amazon, Walmart, Best Buy and Toys R Us.
Amazon says it offers competitive prices and does not offer price matching when an item's price drops after a customer buys it, with the exception of televisions. Walmart matches the prices of print ads from competitors and said it has no plans to change its policy. Walmart also says it checks the prices of 30,000 items at competing chains each week to make sure it has the lowest prices.
Best Buy matches the price from a local competitor's store, a local Best Buy store or its own web site. Toys R Us matches in-store prices and certain online prices.
Shares of Target were down 60 cents at $60.70 in afternoon trading on the New York Stock Exchange.

US stocks slip ahead of earnings season kickoff
Stocks are falling on Wall Street as traders wait for corporate earnings reports to start rolling in.
The Dow Jones industrial average was down 65 points at 13,318 at midday Tuesday. The Standard & Poor's 500 index fell seven points to 1,453. The Nasdaq composite index fell 17 to 3,081.
Aluminum maker Alcoa becomes the first company in the Dow average to report earnings after the close of trading.
Other companies that have begun reporting turned in mixed results.
Yum brands, the parent company of KFC, Taco Bell and Pizza Hut, dropped after reporting problems with a chicken meat supplier.
Monsanto, an agricultural products maker, soared after reporting sharply higher earnings thanks to booming sales of crop seeds in Latin America.

WASHINGTON, DC ? As part of its continued commitment to rigorous oversight of oil and gas activities in the Arctic, Secretary of the Interior Ken Salazar today announced that the Department has launched an expedited, high-level assessment of the 2012 offshore drilling program in the Beaufort and Chukchi Seas to review practices and identify challenges as well as lessons learned. The review, which is expected to be completed within 60 days, will pay special attention to challenges that Shell encountered in connection with certification of its containment vessel, the Arctic Challenger; the deployment of its containment dome; and operational issues associated with its two drilling rigs, the Noble Discoverer and the Kulluk.
The review is consistent with the Administration?s commitment to safe and responsible exploration for energy resources in the Artic and will help inform future permitting processes in the region. The United States Coast Guard will provide technical assistance for the review.
?Developing America?s domestic energy sources is essential for reducing our dependence on foreign oil and creating jobs here at home and the Administration is fully committed to exploring for potential energy resources in frontier areas such as the Arctic,? said Salazar. ?Exploration allows us to better comprehend the true scope of our resources in the Arctic and to more fully understand the nature of the risks and benefits of development in this region, but we also recognize that the unique challenges posed by the Arctic environment demand an even higher level of scrutiny.?
The review of Shell?s Arctic activities will be led by Interior?s Bureau of Ocean Energy Management (BOEM) Director Tommy Beaudreau, who has been selected to serve as the Acting Assistant Secretary for Land and Minerals Management. The review will look at Shell?s safety management systems, its oversight of contracted services, and its ability to meet the strict standards in place for Arctic development.
?As part of our Department?s oversight responsibilities, our review will look at Shell?s management and operations in the Beaufort and Chukchi Seas,? said Beaudreau. ?We will assess Shell?s performance in the Arctic?s challenging environment.?
During limited preparatory drilling operations last season, Shell constructed top-hole sections for one well each in the Chukchi Sea and the Beaufort Sea. BSEE conducted unprecedented oversight and had inspectors present onboard each Shell rig around the clock throughout those operations.
?The Bureau of Safety and Environmental Enforcement demands operators make safety at all levels at all times their number one priority, and we expect the highest level of performance from operators in the Arctic,? said BSEE Director James A. Watson. ?As we oversee historic domestic drilling, BSEE will continue its unprecedented oversight of drilling activities in the Arctic and we will continue to hold anyone operating in public waters to the highest safety and environmental standards.?
In the wake of the Deepwater Horizon tragedy, the Obama Administration put in place significant new safeguards to protect the environment and the workers onboard offshore drilling rigs. These new safety measures include heightened drilling safety standards to reduce the chances that a loss of well control might occur in the first place, as well as a new focus on containment capabilities in the event of an oil spill.
As part of the Obama Administration?s all-of-the-above energy strategy, domestic oil and gas production has grown each year the President has been in office, with domestic oil production currently higher than any time in nearly a decade and natural gas production at its highest level ever. Foreign oil imports now account for less than 50 percent of the oil consumed in America ? the lowest level since 1995.
The U.S. Coast Guard today also announced it has initiated a comprehensive marine casualty investigation regarding the recent grounding of the drill rig Kulluk. BSEE and the National Transportation Safety Board will provide technical assistance for the Coast Guard?s investigation.
